In response to Monday’s Supreme Court ruling on the A-12 case, Boeing general counsel Michael Luttig said Boeing is “pleased with today’s win” and “the court’s unanimous decision to overturn the government’s default termination of the A-12 program.” He added, “It has always been our view that the default termination was improper.” A General Dynamics spokesman said that its legal team was reviewing the court’s decision and would comment at a later date.
The Air Force and Boeing agreed to a nearly $2.4 billion contract for a new lot of KC-46 aerial tankers on Nov. 21. The deal, announced by the Pentagon, is for 15 new aircraft in Lot 11 at a cost of $2.389 billion—some $159 million per tail.
